Tanker may not yet leave Sri Lankan waters

The Attorney General Dappula de Livera has informed the Marine Environment Protection Authority (MEPA) on Oct 1 that negotiation pertaining to claim regarding marine pollution caused by the 'New Diamond’ were pending.
He has further told the MEPA that other claims were yet to be settled by the owners of the vessel, according to the Attorney General’s coordinating officer State Counsel Nishara Jayaratne. The MEPA has meanwhile stated that approval cannot be granted to the tanker to leave Sri Lankan waters until the negotiations are concluded.
The MEPA has informed the Attorney General on the matter.

Tanker may be towed to Khor Fakkan

The 'New Diamond,' can still not to be unloaded at the offshore terminal of the Kandla Port Trust in northwestern India. The ship will instead be towed even further - across the Arabian Sea to the port of Khor Fakkan in the United Arab Emirates. Only now has Sri Lanka received the guarantees of financial compensation for the salvage work that allows the ship to leave the country's 200 nautical mile zone. Indian Coast Guard provides escort for crippled tanker

The Indian Coatrguard had mobilized seven ships and two aircraft for the operation to tow the 'New Diamond' to Fujairah and had provided necessary support to the Sri Lankan authorities. From its current position off Dondra Head, the southernmost point of the Sri Lankan coast, the tanker was headed to the largest port on the Eastern seaboard of the UAE. The pollution control vessels 'Samudra Pavak' and 'Sumdra Prahari with an onboard helicopter and the ICSG 'Shaunak' with pollution response gear have been deployed to escort the 'New Diamond' as it is being towed away from the Sri Lankan Coast. The Coastguard ships were meant to provide preventive pollution response cover in case of any oil leakage contingency during the passage of the vessel to Fujairah. The tanker was expected to take several weeks to reach its destination, given the drastic reduction in speed while being safely towed.

Alleged criminal case to be heard

The alleged criminal case against the Captain of the 'New Diamond' was expected to be heard on Oct 12. It will be determined whether the master was responsible for the spread of the fire off the coast of Sri Lanka. He was made responsible for the oil spill and the failure to report it in time. The Attorney General of Sri Lanka, Dappula de Livera, has already filed indictments in the Colombo High Court against the Captain under two counts that carry a maximum penalty of 20 million rupees. The Captain has been indicted for failing to operate the ship's automatic fire extinguishing system, failing to prevent an accident and failing to notify responsible agencies and authorities immediately after the accident.

The Colombo High Court has issued an order, asking the captain of the 'New Diamond' to pay US$ 65,000, after he pleaded guilty to the charges on Oct 14. The order further said that the Captain was released after paying the fine. Earlier, the Attorney General had indicted the Captain in the Colombo High Court on charges of failing to douse the fire and committing maritime pollution. The court hearing against the captain was held in Colombo on Oct 11. The Colombo Chief Magistrate ordered the captain of the vessel to appear before the Colombo High Court when a summons is issued on him. During the proceeding, Deputy Solicitor General appeared on behalf of the Criminal Investigation Department and informed the court that indictments were filed against the alleged suspect on Oct 8.

EN IMAGESUne opération internationale est en cours pour tenter d’éviter une marée noire, le bateau menaçant de se briser et de déverser son fioul dans l’océan Indien.

Un porte-conteneurs en feu depuis neuf jours au large du Sri Lanka continuait à relâcher, samedi 29 mai, sa cargaison de tonnes de granulés de plastique sur le littoral du pays, pendant qu’une opération internationale a été lancée pour tenter d’éviter une marée noire dans l’océan Indien.

Le MV X-Press-Pearl, navire de 186 mètres de long immatriculé à Singapour, a été fragilisé par les flammes et menace de se briser face aux plages de Colombo, capitale économique du Sri Lanka. Le déversement dans l’océan des 278 tonnes de fioul de soute et des 50 tonnes de gazole marin qu’il transporte, en plus du combustible présent dans son réservoir, provoquerait une catastrophe environnementale.

Les autorités du Sri Lanka ont interdit la pêche dans une zone de 80 kilomètres de long autour du navire. L’incendie semblait enfin maîtrisé selon les autorités, samedi, mais de nombreuses interventions sont encore nécessaires pour sécuriser le navire.

« Il y a encore de la fumée et on peut voir quelques flammes par intermittence, mais le navire est maintenant stable », a déclaré samedi à l’Agence France Presse (AFP) le porte-parole de la marine sri-lankaise, le capitaine Indika de Silva. Un hélicoptère militaire avait largué mercredi près d’une demi-tonne de produits chimiques ignifuges sur le navire, en vain, et la lutte conte les flammes s’était poursuivie depuis.

Enquête sur des fuites d’acide nitrique à bord
Le porte-conteneurs faisait route vers Colombo en provenance l’Etat indien du Gujarat, lorsque le feu s’est déclaré à 14 kilomètres au large des côtes. Il aurait pris dans un conteneur d’acide nitrique, a déclaré vendredi Dharshani Lahandapura, présidente de l’Autorité de protection de l’environnement marin du Sri Lanka.

Les autorités enquêtent sur les circonstances entourant des fuites d’acide nitrique, que l’équipage aurait remarquées avant même d’entrer dans les eaux sri-lankaises. Le navire transportait 25 tonnes d’acide nitrique, ainsi que certaines quantités d’éthanol, parmi ses 1 500 conteneurs.
